[publictransport] Can Connex be independent?

As far as I understand, no they can't.

 

It has to be a govt decision and enshrined in the Victorian Fares and
Ticketing Manual (or something along those lines).

Forgive my ignorance but; 
if the government gets rid of the ban, given that Connex is a private
company, can they just implement a ban under their own rules?
